CarInspect conditions of use

OVERVIEW

This website and its services are operated by 16931821 Canada Inc. (“CarInspect”) doing business in the United States through its California foreign registration.

By accessing or using our website or booking an inspection, you agree to be bound by these Terms and Conditions of Sale and Use (“Terms”).

CarInspect may update these Terms from time to time by posting a revised version on this page.

Any material change will be communicated through reasonable means (such as email or notice on our website).

Your continued use of the site or our services after such updates constitutes acceptance of the revised Terms.

 

ARTICLE 1 – CONDITIONS OF USE OF OUR WEBSITE

The use of our products for any illegal or unauthorized purpose is prohibited, and you shall not, in connection with the use of the Service, violate the laws of your jurisdiction (including but not limited to To copyrights).

You must not transmit worms, viruses or any other destructive code.

Any breach or violation of these Terms may result in actions described in Article 14 – Termination and Suspension.

 

ARTICLE 2 – GENERAL CONDITIONS

On this site, the terms “we”, “us” and “our” may refer to CarInspect AND to Technicians who are members of the CarInspect network for purposes of simplifying the understanding of Users. 

Below we will present the different parts and their role.

  • CarInspect owns the website and the app.carinspect.com/client platform allowing (1) Users to share their need to do an inspection on a vehicle, (2) to offer visibility to Technicians who wish to carry out inspections and (3) ensure that the connection works properly.
    CarInspect’s main activity is car brokerage by accompanying and advising the User in his request for inspection and may be required to guide him in the choice of Technician. 
  • The Technician is a self-employed professional with the necessary skills to perform inspections as described on the CarInspect website. Technicians act as independent contractors, not as employees, agents, or representatives of CarInspect. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between CarInspect and the Technician.
    Technicians are responsible for complying with all laws and regulations applicable to their professional activities and self-employed status. CarInspect is not responsible for any breach of such obligations.
    By subscribing to CarInspect, each Technician receives login credentials granting access to the app.carinspect.com/client platform, enabling them to offer inspection services and use the technological tools provided by CarInspect to help perform their work. Technicians agree to carry out inspections in accordance with the specifications and service standards published on the CarInspect website, to the best of their ability and within the constraints of the inspection context.
  • The User is the person wishing to carry out an inspection on a vehicle and can share their request via the form available on app.carinspect.com/client.

When booking, the User makes full payment, which includes the fees charged by the Technician and the management fees charged by CarInspect.

By using CarInspect’s brokerage, the User expects to receive the service described in the CarInspect specifications set out on the website.

It is the User’s responsibility to ensure that the vehicle remains available for inspection for a minimum of 48 business hours, including by placing a deposit or reservation with the seller if necessary.

CarInspect is not responsible if the vehicle is sold, transferred, or otherwise becomes unavailable before the inspection can take place.

In addition, it is the responsibility of the User to ensure that the owner agrees to allow a CarInspect network Technician to perform the inspection on the vehicle, including a test drive if required.

Neither CarInspect nor the Technician shall be held responsible if the test drive cannot be performed due to the owner’s refusal or due to inadequate or unsafe conditions (for example: absence of license plate, no winter tires, or unplowed road).

Non-Circumvention. For 12 months following any booking or introduction made through CarInspect, the User agrees not to solicit, hire, or engage any Technician directly for vehicle inspections or related services, except through CarInspect.

We reserve the right to refuse access to services for any reason at any time for any reason.

You understand that your content (excluding your credit card information) may be transferred in an unencrypted manner, and this implies (a) transmissions on various networks; And (b) changes to comply and adapt to technical requirements for the connection of networks or devices. Credit card information is always encrypted during transmission over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service or use of the Service or any access to the Service or contact on the website through which the Service is provided without permission Written express prior to our part.

The titles used in this agreement are included for your convenience, and will not limit or affect these Terms.

 

ARTICLE 3 – ACCURACY AND RELIABILITY OF INFORMATION

The information and materials available on our website are provided for general informational purposes only. While CarInspect makes reasonable efforts to ensure that all content is accurate and up to date, we do not warrant or guarantee that every description, price, or detail presented on the site is complete, current, or error-free.

You acknowledge that any reliance on website information, promotional materials, or examples is at your own risk. Only the details specified in your confirmed booking, invoice, and inspection report are contractually binding between you and CarInspect.

 

ARTICLE 4 – AMENDMENTS TO SERVICE AND PRICES

The prices of our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (and any part or content thereof) without notice and at any time.

We will not be liable to you or any third party for any change in price, suspension or interruption of the Service.

 

ARTICLE 5 – REFUND POLICY 

5.1. Customer Cancellations

  • Inspection not yet scheduled:
    The customer will not receive a refund but will be granted an inspection credit for future use.
  • Inspection scheduled (less than 12 hours before the appointment):
    No refund or inspection credit will be issued.
  • Inspection scheduled (more than 12 hours before the appointment):
    No refund will be issued, but the customer will receive an inspection credit for future use.
  • Customer cancels during the inspection process:
    No refund or inspection credit will be issued.
  • Customer cancels while the inspector is already en route to the vehicle:
    No refund or inspection credit will be issued.
  • Customer cancels on a weekend when the customer service department is closed:
    The cancellation will be processed on the next business day.
    No refund will be issued, but an inspection credit will be granted.
  • Customer dissatisfaction or disagreement with the report:
    If a customer is unhappy with the service, the report, or believes the inspector may have missed something, no refund or credit will be provided.
    CarInspect inspections are performed by qualified inspectors using professional judgment, but human error is possible, and CarInspect cannot be held responsible for any undetected or later-developing issues.

     

5.2. Seller-Related Situations

  • Seller arrives more than 20 minutes late or fails to show up:
    The inspector will leave the inspection location, and no refund or inspection credit will be granted.
  • Vehicle sold before inspection (including weekends):
    No refund will be issued, but an inspection credit will be granted.
    It is the customer’s responsibility to ensure the vehicle is reserved for at least 48 business hours (for example, by leaving a deposit).
    CarInspect cannot be held responsible if the vehicle is sold before the inspection takes place.

     

5.3. CarInspect Cancellations

If CarInspect cancels an inspection due to internal reasons (e.g., no inspector available or logistical constraints):
The customer may choose between a full refund or an inspection credit for future use.

5.4. Additional Notes

  • Credits issued under this policy are non-refundable and may be applied toward a future inspection.
  • No exceptions will be made outside the cases listed above.
  • Refunds, when applicable, will be processed using the original method of payment.

     

5.5. Liability Limitation

Liability for inspections and any related services is limited as described in Article 11 – Exclusion of Warranties and Limitation of Liability.

 

ARTICLE 6 – ACCURACY OF INVOICING AND ACCOUNT INFORMATION

You agree to provide current, complete and accurate order and account information for all orders placed on  app.carinspect.com/client. You agree to promptly update your information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you if necessary. You can notify CarInspect of any changes by emailing “hello@carinspect.com”.

 

ARTICLE 7 – THIRD-PARTY TOOLS AND LINKS

7.1 Optional Third-Party Tools

We may provide access to third-party tools or software integrations that are not owned, controlled, or monitored by CarInspect.
You acknowledge and agree that:

  • These tools are provided “as is” and “as available”, without any warranties, representations, or conditions of any kind.
  • CarInspect does not guarantee the accuracy, reliability, or performance of any third-party tool.
  • Your use of any third-party tool is entirely at your own risk and discretion, and you should review and accept the applicable terms and privacy policies of the relevant provider before use.
  • CarInspect shall not be held liable for any damages, data loss, or other consequences arising from or related to your use of third-party tools made available through our website or platform.

7.2 Third-Party Links and External Content

Our website or platform may contain links to, or content from, third-party websites or resources that are not affiliated with CarInspect.
We do not review, control, or endorse the accuracy, legality, or reliability of such external websites, content, products, or services.

CarInspect shall not be responsible or liable for any loss, damage, or dispute arising from your access to or interaction with third-party websites or their operators.
You are encouraged to review the terms, conditions, and privacy policies of those third parties before engaging in any transaction or sharing personal information.

 

ARTICLE 8 – FORCE MAJEURE

CarInspect will not be liable for any delay or failure to perform caused by events beyond its reasonable control, including but not limited to severe weather, natural disasters, power or internet outages, labour disputes, government actions, epidemics/pandemics, or third-party platform failures. In such cases, CarInspect may postpone or cancel an inspection and will work with the customer to reschedule at the earliest reasonable time.
Force majeure does not excuse payment obligations for services already rendered or costs already incurred, except as required by applicable law.

 

ARTICLE 9 – ERRORS, INACCURACIES AND OMISSIONS

We reserve the right to correct any error, inaccuracy, omission, and to change or update information or cancel orders, if any information in the Service or on any other associated website is inaccurate, and , at any time and without notice (including after you have placed your order).

 

ARTICLE 10 – PROHIBITED USES

You agree to use the CarInspect website, platform, and services in a lawful, secure, and responsible manner.

You are strictly prohibited from:

  • (a) Using the website or platform for any illegal, fraudulent, or unauthorized purpose;
  • (b) Attempting to gain unauthorized access to any part of the website, platform, or related systems;
  • (c) Interfering with, disrupting, or damaging the security, functionality, or performance of the website, platform, or any connected network;
  • (d) Introducing or transmitting malware, viruses, or harmful code, or attempting to compromise data or security in any way;
  • (e) Copying, reproducing, or extracting data, code, or content from the platform except as expressly permitted in writing by CarInspect;
  • (f) Submitting false, misleading, or defamatory information;
  • (g) Using the website or its content to infringe upon intellectual property rights, privacy rights, or applicable laws.

     

CarInspect reserves the right to suspend or terminate access to its website or services and to take any legal action deemed necessary, including claims for damages, in the event of any violation of these prohibitions.
CarInspect may also cooperate with law enforcement authorities or other relevant parties in investigating and prosecuting unlawful activities.

 

ARTICLE 11 – EXCLUSION OF WARRANTIES AND LIMITATION OF LIABILITY

11.1 General Disclaimer

All CarInspect services, including pre-purchase inspections, inspection reports, and any related materials, are provided “as is” and “as available.”
CarInspect makes no representations or warranties, express or implied, regarding the accuracy, completeness, or reliability of any inspection, report, or information provided.

To the fullest extent permitted by law, CarInspect expressly disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

 

11.2 Limitations Specific to Inspections

CarInspect inspections are visual assessments performed without disassembly or lifting of the vehicle.
Inspectors base their evaluations solely on what can be seen, heard, or observed at the time of inspection.
Environmental factors — including lighting, weather, and vehicle cleanliness — may affect visibility or accuracy. For optimal results, vehicles should be clean, dry, and well-lit.

  • Technicians do not wash, clean, or disassemble any vehicle components.
  • Vehicle Identification Numbers (VINs) may be recorded but not verified for authenticity, history, or title.
  • Each inspection is limited to the components expressly listed in the CarInspect inspection report.
  • If an element is not listed or marked as “N/A”, it should be assumed not inspected, for reasons such as the impossibility or inaccessibility of inspecting it.

     

The inspection points listed on the CarInspect report will be inspected only if it is physically possible to do so.
Examples include (but are not limited to):

  1. On some sports or modified vehicles, the hood or undercarriage may be too low to allow access.
  2. Certain components, such as brakes, cannot be fully assessed when disassembly is required.
  3. If the inspector cannot perform a test drive (e.g., due to lack of plates, unsafe conditions, or owner refusal), some drivability or performance elements will not be inspected.
  4. If the vehicle does not have a specific component or option, the related inspection point will be marked as not applicable (N/A).

     

If the client requests the inspection of a specific element not included in the standard report, the inspector will make a reasonable effort to inspect it, but no guarantee can be given that it will be accessed, evaluated, or included in the final report.

Road tests are performed within the legal speed limits of the inspection location.

You understand that while CarInspect inspectors follow industry-standard techniques to detect issues, not all potential problems may be identified.
The condition and age of the vehicle at the time of inspection should be taken into account, and the findings should be reviewed accordingly.
Many aspects of an inspection are subjective; the Technician provides their professional opinion, and your own conclusions may differ.

Inspectors will assess vehicles to the best of their ability, using professional judgment and standard inspection practices, within the constraints of safety and accessibility.

The inspection reflects the condition of the vehicle at a specific point in time only. Components may fail or defects may appear immediately after the inspection.
CarInspect is not responsible for any hidden defects, failures, or issues that were not visible or detectable during the inspection, nor for any defect or malfunction occurring after the inspection is completed.

The report does not replace an official state, provincial, safety or emissions (smog) certificate and does not include verification of manufacturer recalls. Buyers are solely responsible for verifying such information before purchase.

CarInspect is not responsible for any transaction, negotiation, or dispute between buyers, sellers, or third parties related to an inspected vehicle.

 

11.3 No Vehicle Warranty Created by Inspection

You acknowledge that a CarInspect inspection does not create any warranty—express or implied—on the vehicle itself.
Your only possible recourse for vehicle defects, whether or not identified in the inspection, is limited to any warranty offered by the seller of the vehicle.

Purchasing a vehicle following an inspection remains entirely your decision. You assume full responsibility for all maintenance and repair costs thereafter, whether or not covered elsewhere.

 

11.4 90-Day Used Car Warranty (KM+ Partner Program)

CarInspect offers a 90-day powertrain warranty on vehicles graded A or B that have been inspected by CarInspect.

This warranty is provided through our partner, KM+ Warranty, an independent third-party warranty company.

Eligibility: Vehicles under 10 years old, with fewer than 200,000 km, owned by a Canadian resident located in North America, or by an American resident located in North America.

Coverage: Major powertrain components — including the engine, transmission, differential, and transfer case.

Limit: Up to $1,500 per covered repair (parts and labour). No deductible applies.

CarInspect is not the warranty provider and bears no liability for warranty claim outcomes, repair results, or decisions made by KM+ Warranty.

 

11.5 Limitation of Liability

To the maximum extent permitted by law, CarInspect, its affiliates, directors, employees, contractors, and agents shall not be liable for:

  • any indirect, incidental, consequential, or special damages (including loss of business, profits, or data);
  • any costs related to financing, delays, operational losses, or expected savings;
  • any damages arising from inspection findings, reports, or use of the website.

     

You agree not to hold CarInspect, its shareholders, affiliates, licensors, partners, members, directors, officers, employees, agents, successors, or content providers (collectively, the “Members”) liable for any damage, expense, loss, action, claim, or dispute — whether known or unknown — arising out of or related to your use or inability to use the Platform or any Service.
This includes, without limitation, any liability connected to the conduct, acts, delays, or omissions of any user or third-party provider (including any relationship or transaction between you and a third-party provider), as well as any dispute, instruction, advice, act, or service provided by CarInspect or its Members, and any destruction, loss, or alteration of your information.

If CarInspect or any of its Members is found to be liable despite the above, the total aggregate liability shall not exceed the amount paid for the specific inspection or service giving rise to the claim, except where prohibited by applicable law.

These limitations apply regardless of the legal basis of the claim and survive termination of these Terms.

Nothing in these Terms limits liability for fraud, willful misconduct, or gross negligence, or any liability that cannot be limited under applicable law.


11.6 Inspection Report – License, Ownership, and Reliance

The inspection report, photos, and related materials are owned by CarInspect. CarInspect grants the purchasing customer a limited, non-exclusive, non-transferable license to use the report solely to evaluate the inspected vehicle. Any reproduction, distribution, resale, publication, or use by third parties is prohibited without CarInspect’s prior written consent. No third party may rely on the report, and CarInspect assumes no duty of care to persons other than the purchasing customer.

 

ARTICLE 12 – INDEMNIFICATION

You agree, to the extent permitted by applicable law, to indemnify, defend, and hold harmless CarInspect, its parent company, subsidiaries, affiliates, directors, officers, employees, agents, contractors, licensors, service providers, subcontractors, and partners (collectively, the “Indemnified Parties”) from and against any and all claims, damages, liabilities, losses, costs, and expenses — including reasonable attorney’s fees — arising from or related to:

  • (a) your use or misuse of the CarInspect website, platform, or services;
  • (b) your violation of these Terms and Conditions or any applicable law or regulation;
  • (c) your infringement of any third-party rights, including intellectual property, privacy, or contractual rights; or
  • (d) any dispute or transaction between you and a third party (including a vehicle seller, dealer, or inspector).

     

This indemnification obligation will survive the termination of your access to the website or services.

 

ARTICLE 13 – SEVERABILITY

If any provision of these Terms and Conditions is found to be illegal, invalid, or unenforceable by a court or competent authority, that provision will be applied to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

 

ARTICLE 14 – TERMINATION

CarInspect may, at its sole discretion, suspend or terminate your access to the website or Services, in whole or in part, at any time and without prior notice, if it believes that:

  • you have violated these Terms or any applicable law;
  • your activity poses a risk of fraud, abuse, or harm to CarInspect, its users, or partners; or
  • continued access would compromise the security or integrity of the platform.

     

CarInspect will not be liable to you or any third party for suspension or termination under this Article, except where prohibited by applicable law, and may retain certain information for record-keeping, fraud prevention, or legal compliance.

If termination occurs, you remain responsible for all amounts due up to and including the termination date.

You may also terminate these Terms at any time by ceasing to use our Services and notifying us at hello@carinspect.com.

Termination of your account or access does not affect CarInspect’s rights and obligations that arose before termination, including payment obligations, limitation of liability, and dispute resolution provisions.

 

ARTICLE 15 – ENTIRE AGREEMENT

These Terms and Conditions, together with any policies or guidelines referenced herein (including the Privacy Policy and Refund Policy), constitute the entire agreement between you and CarInspect regarding your use of the website and Services, and supersede all prior or contemporaneous communications, proposals, or agreements, whether oral or written.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

In the event of any ambiguity or inconsistency between these Terms and other communications from CarInspect, the version published on our website shall prevail.

 

ARTICLE 16 – APPLICABLE LAW

These Terms and any dispute, claim, or controversy arising from or related to them, to the website, or to the Services provided by CarInspect, shall be governed by and interpreted in accordance with the laws in force in the jurisdiction where CarInspect is registered, without regard to conflict of law principles.

For Canadian customers, these Terms are governed by the laws of the Province of Québec and the applicable laws of Canada. Any dispute shall be submitted exclusively to the competent courts of Montréal, Québec.

For U.S. customers, these Terms are governed by the laws of the State of California and applicable federal law. Any dispute shall be submitted exclusively to the state or federal courts located in California, U.S.A., where CarInspect maintains its registered agent for service of process.

Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection laws in your province, state, or territory of residence. Any provisions that would restrict such rights are inapplicable to those consumers.
